These Terms and Conditions govern the use of Wispcare's website and in-home elderly care services. By submitting an enquiry, entering into a service agreement, or using our website, you agree to the terms below. If you have questions, please contact us at legal@wispcarenae.
Definitions
- "Wispcare" / "We" / "Us": Wispcare, a care services provider based at No. 236, Section 5, Nanjing East Road, Taoyuan District, Taoyuan 330, Taiwan.
- "User" / "You": Any individual who accesses our website or enters into a service arrangement with Wispcare.
- "Service": The in-home elderly care programs offered by Wispcare, including Weekend Respite Care, Nighttime Monitoring & Comfort, and Premium Holistic Home Care.
- "Care Recipient": The elderly individual receiving in-home care under a Wispcare arrangement.
- "Agreement": The written service agreement between Wispcare and the client, incorporating these Terms.
Acceptance of Terms
By using our website or entering into a service agreement, you confirm that you are 18 years of age or older, that you have the legal capacity to enter into an agreement, and that you accept these Terms in full. If you do not accept these Terms, you should not use our website or proceed with a service arrangement.
Service Description & Availability
Wispcare provides three structured in-home care programs in Taoyuan District and surrounding areas in Taoyuan City, Taiwan. Services are subject to aide availability and geographic coverage. Wispcare reserves the right to decline to enter into a service arrangement in cases where we assess that the scope of care required exceeds what our programs can safely provide.
The specific scope of each service is detailed in the written service agreement provided to you before care begins.
Client Responsibilities
- Provide accurate and complete information about the Care Recipient's health, preferences, and home environment.
- Inform Wispcare promptly of any material changes to the Care Recipient's condition or circumstances.
- Ensure the home environment is reasonably safe for the assigned aide to work in.
- Not ask aides to perform tasks outside the agreed scope of the service arrangement.
- Treat all Wispcare staff with respect and dignity.
Payment Terms
Program fees are as set out in the service agreement and on our website, denominated in New Taiwan Dollars (NT$). Payment terms (timing and method) are specified in the individual service agreement. Late payment may result in suspension of care services. All fees are reviewed annually and any changes will be communicated in advance.
Cancellation terms and any applicable refund conditions are set out in the individual service agreement.
Service-Specific Terms
Each program is governed by its specific terms as set out in the written service agreement. In general:
- Wispcare will endeavour to assign a consistent aide to each arrangement.
- In the event that the regular aide is unavailable, Wispcare will arrange a substitute where possible, with advance notice where time permits.
- Changes to service scope or frequency require mutual agreement in writing.
- Wispcare will follow any documented care plan provided or developed with the family.
Intellectual Property
All content on the Wispcare website — including text, design, and structure — is the property of Wispcare. You may not reproduce, distribute, or use any content without prior written permission.
Disclaimers
Wispcare provides personal care assistance services and does not provide medical or clinical treatment. Our services are not a substitute for professional medical care. We do not make representations about specific health outcomes. Website information is provided for general purposes only and may not reflect your individual situation.
Limitation of Liability
To the extent permitted under applicable law in Taiwan, Wispcare's liability for any claim arising out of or related to our services is limited to the fees paid for the specific service period in question. We are not liable for indirect, incidental, or consequential losses. Nothing in these Terms limits liability for death, personal injury, or fraud caused by negligence.
Termination
Either party may terminate the service arrangement by providing written notice as specified in the individual service agreement. Wispcare may terminate with immediate effect in cases of serious breach, safety concerns, or circumstances making service delivery unreasonably unsafe. On termination, all outstanding fees for services rendered remain due.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of China (Taiwan). In the event of a dispute, we encourage direct communication with us in the first instance. If a dispute cannot be resolved informally, it shall be referred to the courts of Taoyuan District, Taiwan.
Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on our website with a revised "Last Updated" date. For active service agreements, material changes will be communicated directly. Continued use of our services after notification constitutes acceptance.
